Registration of Foreign Citizens on the Territory of the Russian Federation

New rules has been established for the recruitment and hiring of foreign citizens

By Governmental Decree dated March 20, 2015 №257, new rules are being introduced redarding the recruitment and hiring of foreign citizens.

According to the text, regulations for the requirement for foreign workers and work permits will be determined only for foreign citizens who are in Russia according to a visa regime.

It sets the criteria for determining the needs of employers in the recruitment and hiring of foreign employees, including:

- The inability to meet the demand for labor, including through labor reallocation within the Federation or recruitment in other Russian regions;

- Observance of the Government of the allowable share of foreign workers involved in various types of economic activity;

- The presence of possible resettlement of foreign employees (housing, social infrastructure, health care).

In addition, the decree introduces a system of open access to information on the results proposals to recruit and hire foreign employees on the official websites of the Ministry of Labour and Russian senior executive bodies of state within other regions of the Federation.

Russian Ministry of Labour and the supreme executive body of state for the regions of the Russian Federation instructed that the results for the consideration of proposals be placed on their official websites in order to ensure transparency of the Commission and the authorities of the Federation to prepare proposals to recruit and hire foreign employees.
