Tightening of the liability for performing working activities on occupations not specified in the work permit

The bill has been passed in the first reading by the State Duma that establishes liability for performing working activities not specified in the work permit.

Article 13 of the Federal Law №115-FL establishes that a foreign citizen does not have the right to perform work in a profession that is not specified in the work permit, and at the same time, the employer or customer of works (services) is not entitled to recruit foreign citizen to perform work not specified in the work permit.

The bill provides the foreign citizen with administrative liability for activities not specified in the work permit:

- In the regions - in the amount of 2 000 to 5 000 rubles with or without administrative expulsion;
- In Moscow and in the Moscow region from 5000 to 7000 rubles with administrative expulsion from the Russian Federation.

Administrative liability is provided for employers hiring foreign employees to work in the profession not specified in the work permit:

- for officials - a  fine ranging  from 25 000 to 50 000 rubles;
- for legal entities - a fine ranging  from 250 000 to 800 000 rubles, or administrative suspension of activity for a period from 14 to 90 days.

It is worth noting that in Moscow and in the Moscow region there is other administrative liability that includes the following:

- for officials - a fine ranging  from 35 000 to 70 000 rubles;
- for legal entities - a fine ranging  from  400 000 to 1 000 000 rubles, or administrative suspension of activity for a period from 14 to 90 days.
