Foreign citizens will be able to obtain a patent for work in Russia through a representative
A draft law has been submitted to the State Duma, which proposes to allow foreign citizen to obtain a patent for work in Russia through a representative (an authorized organization), and not just personally.
This proposal is related to the fact that the personal presence of a foreign citizen when issuing a patent for work in Russia is not always possible, especially in the Far North, including the Magadan region, where a significant number of foreign citizens work in organizations located far from the administrative centers of the subjects of the Russian Federation.
The initiative has already been supported by the leaders of 11 constituent entities of the Russian Federation, which face similar problems. We are talking about the governments of the Amur Region, the Kamchatka Territory, the Republic of Buryatia, the Murmansk Region, the Republic of Tuva, the Komi Republic and other regions.
It is expected that this bill will contribute to improving the regulation on the legal status of foreign citizens in Russia, reducing administrative barriers in the economy and increasing the overall investment attractiveness of the subjects of the Russian Federation.
It should be kept in mind that, currently the patent is issued to a foreign citizen for a period of 1 to 12 months in person upon presentation of a document certifying his identity and recognized by the Russian Federation in this capacity, as well as a document confirming the payment of personal income tax in the form of a fixed down payment for the period of the patent's validity Item 5-6 of article 13.3 of the Law No. 115-FZ).
