A draft law aimed at protecting the rights of seasonal employees
The Ministry of Labor of Russia has prepared a draft law "On Amending Article 294 of the Labor Code of the Russian Federation", aimed at creating a mechanism to ensure the rights of seasonal employees when they move to the place of seasonal work.
The draft law provides for the mandatory inclusion of conditions in an employment agreement with seasonal employees residing in another locality, when he/she moves by prior agreement with the employer. Such conditions are related to moving and returning to the place of residence at the end of the term or early termination of the employment agreement, depending on the grounds for its termination.
In addition, it was noted that the employer is obliged to compensate for expenses associated with moving an employee to the place of seasonal employment and returning to the place of residence. As a rule, specific amounts of compensation of expenses are determined by a collective agreement or a local regulatory act or the employment agreement.
These proposals are drafted to protect the rights of seasonal employees coming to work in another locality, especially in remote areas with limited accessibility to transport.
