New rules for conducting planned inspections to ensure compliance with labor laws
During the planned inspections of employers to ensure compliance with labor laws, the Labor Inspectorate will use special checklists.
Changes in the procedure for conducting routine inspections are made by the Resolution "On Amendments to the Regulations on the Federal State Supervision over the Observance of Labor Legislation and Other Normative Legal Acts Containing the Norms of Labor Law" prepared by the Ministry of Labor of the Russian Federation.
According to the resolution, in the course of planned inspections, checklists must be used in a mandatory manner. They will contain questions of mandatory requirements of labor legislation and other normative legal acts containing norms of labor law, including mandatory requirements for labor protection.
It is envisaged that the checklists will be applied by state labor inspectors from January 1, 2018, when scheduled inspections are carried out by all employers regardless of the established risk category.
The effective date of changes for legal entities registered as individual entrepreneurs and carrying out entrepreneurial activities without the formation of legal entities belonging to the moderate risk category is from July 1, 2018.
It is assumed that a new approach to conducting planned inspections will increase the transparency of the activities of regulatory and supervisory authorities in the sphere of compliance with labor legislation.
