Responsibility for non-compliance with the terms of the collective agreement on indexation of wages

Specialists of the Ministry of Labor of the Russian Federation noted that in the event of failure to index the wages of employees in the manner and within the time limits set in the collective agreement, the employer will be liable under Part 1, Art. 5.27 of the Code of Administrative Offenses of the Russian Federation (violation of labor legislation and other normative legal acts containing norms of labor law). This is justified by the fact that an employer, while not observing the provisions of the collective agreement, simultaneously violates the requirements of Art. 22 and art. 136 of the Labor Code on the timely payment of wages to employees (Letter No. 14-3 / B-1135 of the Ministry of Labor of the Russian Federation, dated  December 26, 2017).
