New responsibilities of the hosting party


The Federal Law No. 216-FZ of July 19, 2018 "On Amendments to Article 16 of the Federal Law" On the Legal Status of Foreign Citizens in the Russian Federation" was adopted, according to which the inviting party will be obliged to take measures to ensure the foreign citizen observes and complies with the rules of  stay (residence) in the Russian Federation and in terms of compliance with the stated purpose of entry into the Russian Federation, and are actually carried out during the period of residence in the Russian Federation, and during his or her professional activities, as well as to ensure the timely departure of an invited foreign citizen from  the Russian Federation after the expiration of a certain period of stay  in the Russian Federation.

At the same time, the Draft Decree of the Government of the Russian Federation On the procedure by which the inviting party applies measures to ensure compliance by the invited foreign citizen or stateless person to the rules for residing in the Russian Federation in accordance with the declared goal of entry into the Russian Federation, and provides a list of measures that the inviting party should apply in accordance with new requirements.

Such measures include, in particular:

• Delivery of notifications to a foreign citizen with the signature on the need to observe the purpose of entry and stay in the Russian Federation after his or her arrival in the Russian Federation,
• Advance notification of the invited foreign citizen not later than ten days before the expiry of the visa on the need to leave the Russian Federation,
• In the event of non-compliance of the declared purpose of entry by an invited foreign citizen, violation of the term of temporary stay or loss of contact with the foreign citizen, the inviting party is required to inform the relevant territorial body of the Ministry of Internal Affairs of the Russian Federation within five working days from the day one of the aforementioned facts becomes known.

The above mentioned law comes into force on January 16, 2019.
