Registration of Foreign Citizens on the Territory of the Russian Federation

New duties and responsibilities for employers hiring foreign nationals

From January 16th 2019 significant amendments to the Federal law № 115-FZ "On the legal status of foreign citizens in the Russian Federation" come into force, namely the inviting party will be responsible for ensuring the invited foreign person’s / stateless person’s fulfillment of the order of stay/residence in Russia in terms of compliance of the stated objectives of entry into Russia to reality.

Also, the inviting party will be obliged to monitor compliance with the terms of stay and departure from the Russian Federation by the invited person.

At the same time, administrative responsibility is also updated by providing alterations to part 2 of article 18.9 of the administrative Code, that establishes the responsibility now borne by the host party in case prescribed measures are not taken. The fines are as follows:

for individuals - from 2 000 to 4 000 rubles.;
officials - from 45 000 to 50 000 rubles.;
legal entities - from 400 000 to 500 000 rubles.

It should be noted that forms of notifications on these issues are yet to be approved (adoption of Decree of the Government of the Russian Federation and Ministry of internal Affairs orders on this issue is expected in the near future). In this regard, during the transition period (before the approval of official forms), it is highly recommended to apply to qualified lawyers for the preparation of notices in free form.
