About the right of the worker to change credit institution to which the salary has to be transferred
The Russian tripartite commission approved the bill according to which the worker has the right to change credit institution to which the salary has to be transferred.
According to data of Rostrud, the total number of the revealed violations on compensation in 2017 made 113,4 thousand.
Let's remind of indissoluble communication of the right for remuneration for work and the rights for the free order with this money, including storage, placement them on accounts in other banks. In this regard the obstacle to workers in the choice of bank for transfer of the salary is violation of the labor law and Constitution of the Russian Federation.
Also the bill it is offered to conduct the following penalties for violation of the right of the worker at choice of credit institution:
• For officials from 10 000 to 20 000 rub.
• For the persons which are carrying out business activity without formation of legal entity from 1 000 to 5 000 rub.
• For legal entities from 30 000 to 50 000 rub.
In addition, at RTK meeting, changes were made to the Labor code regarding increase in a term by the worker of the written statement about replacement of credit institution to which money (salary) – from 5 to 15 days about day of payment of the salary comes.
It is made for the purpose of elimination of an imbalance between the rights of the worker and obligations of employer.
