Rostrud ruled that only workers who do not have contraindications on health and are supplied with the corresponding individual remedies are allowed to work during cold weather.

It follows from the letter that the duties of the employers include the provision of special places for employees to spend their breaks and the heating of those break rooms; they must be included in working hours and, therefore, be paid.

The factors influencing break duration:

• temperature
• wind strength

It is also established that vacation spots have to be equipped with the special-purpose equipment for heating corresponding to specific temperature conditions.

Moreover, the failure of the employer to comply with these norms entails a mandatory administrative, and in the event of serious consequences for the employee, and criminal liability.
