Regarding the draft law aimed at ensuring payment of wages
The Ministry of Labour has prepared a draft law amending the Labour Code of the Russian Federation on the subject of enforcing the employer's obligation to pay wages and other amounts due to the employee.
The bill provides for the transfer to the Federal Service of Court Bailiffs for enforcement proceedings of the decision of the State Labour Inspector in the event of the employer's failure to comply with its instruction to pay the employee’s wage arrears.
This measure will be applied only to employers who have failed to comply with the order issued by the state labor inspector to rectify violations.
At the same time, only the amount of accrued but not paid wages, which is not contested by the employer, will be subject to penalty, i.e. the amount determined on the basis of the data submitted by the employer to the State Labour Inspectorate.
According to the Ministry of Labor, the bill will allow to settle issues on ensuring the right of employees to compensation of labor in a pre-trial manner. To this end, a draft law has also been prepared, which provides for a simplified procedure for the collection of wage arrears by bailiffs on the decisions of labor inspectorates.
This set of measures will be aimed at substantial repayment of wage arrears.
