On the regulation of relationships between individuals who are not individual entrepreneurs and their employees
Currently, employers can be individuals who enter into an employment relationship with employees for the purpose of personal servicing and assistance in housekeeping in accordance with Article 20 of the Labor Code of the Russian Federation. However, the Ministry of Labor of the Russian Federation has prepared a draft amendment to the Labor Code, excluding from it the mention of individuals who are not individual entrepreneurs as an employer.
The Ministry of Labor explains this by the fact that such activities are usually carried out without the appropriate registration of the relationship, and in fact there is no proper control over compliance of labor legislation as it pertains to this category of people.
