Regarding granting the right to define the profession for which patents are issued to foreign citizens for employment activity in subject regions of the Russian Federation
The Ministry of Labor of Russia proposed to subject regions of the Russian Federation the possibility of making decisions on identifying on patents issued in a subject region the profession (specialty, position, type of work) of a foreign citizen in accordance with the draft Federal Law "On Amendments to the Law of the Russian Federation "On employment in the Russian Federation" and in the Federal Law “On the Legal Status of Foreign Citizens in the Russian Federation" in order to improve the regulation of issues pertaining to the recruitment and use of foreign workers.
In the event such a decision is adopted, the subject regions will have the right to approve the list of professions for which a patent may be issued, or a list of occupations for which it is prohibited on the basis of a patent to recruit and hire foreign citizens arriving in the Russian Federation via a visa-free regime.
Moreover, it provides the right of the subject region of the Russian Federation to make decisions on the establishment of limits on the granting of patents within their territorial jurisdiction
It is also proposed to include the development and maintenance of a register of foreign citizens arriving in the Russian Federation under rules that that does not require a visa and who are carrying out their employment on the territory of the Russian Federation on the basis of patents to functions of the federal executive body authorized by the Government of the Russian Federation and establish a list of information contained in the register.
