About the need to check of authenticity of the foreign citizen’s patent for work by the employer

The Ministry of Labour and Social Protection of the Russian Federation published the letter with explanations concerning checking of authenticity of the foreign citizen’s patent for work with the regard to the fact that companies can be brought to the administrative responsibility for hiring foreigners with false patents.

As Ministry of Labour and Social Protection of the Russian Federation mentioned in their explanations, the Labor Code of the Russian Federation does not include an obligation of employer to verify authenticity of documents which the foreign citizen provide for hiring. At the same time, the company-employer can be brought to the administrative responsibility for labor involvement of the foreigner with violation of requirements of the migration legislation in case of detection of false patent as the criminal code of the Russian Federation establishes responsibility for knowingly false document for the person who uses this document (point 3 of Article 327 of the Criminal Code of the Russian Federation).

In this regard the Ministry of Labor noted that the employer can verify authenticity of the patent which the foreign employee provide for hiring (the letter of Ministry of Labour and Social Protection of the Russian Federation of December 4, 2018 No. 14-2/B-966).
