Regarding the transfer of the employee to another job
Rostrud has clarified the question of a possibility of the employer to refuse an employee’s transfer to another employer and, accordingly, be dismissed on this basis.
In accordance with Article 72.1 of the Labor Code of the Russian Federation, on the basis of a written request of the employee or from his or her written consent, it is possible to transfer the employee to full-time employment to another employer with the mutually agreed upon termination of the employment contract from the previous place of employment.
Rostrud has clarified that the dismissal in connection with the transfer is a dismissal on the basis of the employee’s initiative, so if the two-week notice period for the employer is observed, this possibility exists and the employer does not have the right to refuse the employee to transfer.
