Implementation of Additional Compensation for Employees


The Ministry of Labor of the Russian Federation gave an explanation in relation to the procedures for granting employees who are engaged in work with harmful and (or) hazardous working conditions with shorter working hours, additional annual paid leave and increased pay.

In accordance with this clarification, the employer may independently set higher or additional compensation. The amounts for the provision of appropriate compensation are established by the collective agreement and local regulations taking into account the financial and economic situation of the employer.

In order to establish the appropriate amount of compensation an employer may use:

· List of industries, departments, professions and positions with hazardous conditions and in which the employee has been granted and entitled to additional leave and reduced working hours approved by the resolution of the State Labor Committee of the USSR from 25.10.1974 N 298/P-22

· Standard provision on the assessment of working conditions in the workplace and the procedures for applying industry lists of jobs for which it can be established requiring additional payments for working conditions approved by the resolution of the State Labor Committee of the USSR from 03.10.1986 N 387/22-78

· Other existing regulations establishing appropriate compensation that are not contrary to the Labor Code of the Russian Federation.
